Do I Need An Attorney?

You have a right to represent yourself but if you choose to represent yourself the judge that presides over your case will expect you to follow the same legal procedures as an attorney would have to follow.  Legal procedure can be complicated.  An attorney has expertise using legal procedures.  It’s good to have an expert on your side.
What are my rights?

You have rights when you are stopped by the police :
You should know and understand your rights.  Your legal rights are based on the Fifth Amendment of the Constitution which guarantees you the right to be free from self-incrimination.  The police must read you your Miranda rights prior to interrogating you: 

  • You have the right to remain silent
  • Anything you say can and will be used against you in a court of law
  • You have the right to an attorney
  • If you cannot afford an attorney one will be appointed for you

You also have rights when you appear in court :
  • You are presumed to be innocent
  • You have a right to be represented by an attorney
  • You have a right to a trial before either a judge or a jury
  • The government must prove that you are guilty beyond a reasonable doubt
  • You have the right to ask questions to the government’s witnesses
  • You have a right to have witnesses testify on your behalf
  • You have the right to make witnesses come to court by subpoena
  • You have a right to remain silent
  • You have a right to have an attorney present for any line-ups or interrogation
